Removing rows with scrolling enabled

Has anyone else had the problem where after removing a row with the table.row('.selected').remove().draw( false ); function
the scroll reverts to paged.
I should add that I am using jquery tabs and have 2 tables active and the error only shows itself when rows are selected in both tables
